Franek is a postcode-exclusive builder lead generation network operated by Panelhome Industries Pty Ltd trading as Franek, a company incorporated in Victoria, Australia. Franek connects qualified homeowners with verified residential builders. References to "Franek", "we", "us", or "our" in these terms refer to Panelhome Industries Pty Ltd trading as Franek.
By accessing or using franek.com.au (the "Site"), you agree to be bound by these terms. If you do not agree, you must not use the Site.
Permitted use
You may use the Site to learn about Franek's services, submit an enquiry as a homeowner, or apply to join the network as a builder. All other use requires Franek's prior written consent.

Intellectual property
All content on this Site — including the Franek name, wordmark, Franek Verified seal, text, graphics, and layout — is owned by or licensed to Franek and protected by Australian copyright and trade mark law. Nothing on this Site grants you any licence or right to use Franek's intellectual property without express written permission.
Third-party links
The Site may contain links to third-party websites. Franek does not control, endorse, or accept responsibility for those sites or their content. Visiting third-party sites is at your own risk.
By submitting a builder application through franek.com.au, you agree to the following terms.
Eligibility
Applicants must hold a current builder's licence issued by the relevant state authority, current home building insurance, and a demonstrable track record of completed residential projects. Franek will verify these requirements as part of the application process.
Vetting and acceptance
Submission of an application does not guarantee acceptance. Franek reserves the right to accept or decline any application at its absolute discretion, without being required to provide reasons. Acceptance is based on licence status, insurance currency, project history, references, and financial stability.
Territory subscriptions
Accepted builders may subscribe to one or more postcode territories on a month-to-month basis. Subscriptions are subject to a separate Territory Subscription Agreement which governs pricing, first right of refusal mechanics, cancellation, and any changes to the subscription terms.
Ongoing compliance
Verified builders must maintain their licence and insurance currency for the duration of their membership. Franek may suspend or terminate membership if a builder's licence lapses, insurance expires, or Franek becomes aware of conduct inconsistent with the Franek standard.
Franek is free for homeowners to use. By submitting a homeowner enquiry through the Site, you agree to the following.
Accuracy of information
You must provide accurate and complete information about your project, including land status, finance position, budget, and timeline. Franek qualifies enquiries based on the information you submit. If the information is incorrect or misleading, Franek may decline to proceed with your enquiry.
Introduction service only
Franek's role is to introduce qualified homeowners to verified builders. Franek is not a party to any building contract and is not responsible for the performance, conduct, or outputs of any builder introduced through the network. Any building contract is solely between you and the builder.
No guarantee of introduction
Franek does not guarantee that an introduction will be made for every enquiry submitted. Introductions depend on territory coverage, builder capacity, and the outcome of Franek's qualification review.
The Franek Verified seal is a mark of quality issued by Franek to builders who have passed its vetting process. Use of the seal is subject to the following conditions.
The seal may only be used by current, active Franek members. It may be displayed on vehicles, site hoarding, proposals, scope documents, and the builder's own website — solely in the form provided by Franek and in accordance with Franek's brand guidelines.
The seal must not be altered, reproduced in modified form, used by any third party, or displayed after membership has been suspended or terminated. Unauthorised use of the Franek Verified seal is an infringement of Franek's intellectual property rights.
The seal signals that a builder has met Franek's vetting criteria at the time of joining. It is not an ongoing guarantee of performance and does not constitute a warranty or endorsement by Franek of any specific project or outcome.

To the maximum extent permitted by law, Franek excludes all liability for any loss or damage (including direct, indirect, incidental, special, or consequential loss) arising from:
Where Franek's liability cannot be excluded by law (including under the Australian Consumer Law and the Competition and Consumer Act 2010 (Cth)), Franek's liability is limited to, at Franek's election, the re-supply of the relevant service or the cost of having the relevant service supplied again.
